    Trump Appeals to SCOTUS Over Blocked Mail-In Voting Order

    President Donald Trump is asking the U.S. Supreme Court to intervene after lower courts blocked key portions of his executive order aimed at tightening mail-in voting rules ahead of the November midterm elections. The administration argues the injunction prevents federal agencies from even evaluating how to lawfully implement the order, while opponents contend the president exceeded his constitutional authority.

    The case marks the latest chapter in the ongoing legal battle over election administration. With Republicans emphasizing election integrity and Democratic-led states warning of voter confusion and federal overreach, the Supreme Court’s decision could have significant implications for how mail-in voting is administered this fall.

    The injunction irreparably harms the government because even if plans to implement the executive order “end up being entirely lawful, there is not enough time to obtain ordinary appellate relief from the injunction in order to carry them out before the November election.”

    Sauer said that in the executive order, the president merely commanded his subordinates to assess applicable laws to determine what appropriate action they may take to implement the order.

    “In other words, if it turns out that there is no lawful way to implement the Executive Order’s directives, the Order itself instructs the agencies not to take action. The district court was wrong to read that command out of the Order,” he said.

    The executive order, signed on March 31, sought to strengthen oversight of mail-in voting by directing the Department of Homeland Security to compile lists of voting-age U.S. citizens and instructing the U.S. Postal Service to develop standards for handling mail-in and absentee ballots used in federal elections. A coalition of 23 Democratic-led states and the District of Columbia challenged the order, arguing that election administration is largely governed by federal and state law rather than unilateral executive action.

    A federal district court agreed with those arguments in June, concluding that the president lacked authority to implement several provisions of the order without congressional authorization. Last week, the U.S. Court of Appeals for the First Circuit upheld that ruling, reasoning that allowing the order to take effect so close to the election could create confusion for voters and election officials. The Supreme Court will now decide whether those lower court rulings should remain in place while the litigation continues.

    Election integrity has remained one of the defining issues of President Trump’s second administration. Supporters argue that stronger safeguards help protect public confidence in elections and reduce opportunities for fraud, while critics contend that some proposed reforms could create administrative burdens or discourage lawful voting. Regardless of the outcome, the Court’s decision is likely to influence both the conduct of this year’s elections and the ongoing debate over the proper balance of authority between Congress, the states, and the executive branch.
