    Did New Jersey Ban Pro-Life Prayer?

    New Jersey Gov. Mikie Sherrill has signed a new law strengthening protections around abortion, prompting concerns that its language could be used against peaceful pro-life advocates. New Jersey Right to Life warns that broadly defined prohibitions on intimidation and interference could potentially expose sidewalk counselors and those praying outside abortion facilities to criminal penalties.

    The measure does not explicitly call for banning prayers outside abortion centers but authorizes taking civil actions against a person deemed to be unlawfully interfering with another individual’s reproductive healthcare services.

    “Peaceful sidewalk counseling, prayer, holding signs, or simply offering help and alternatives outside a facility can easily be labeled ‘intimidation’ by someone who claims to feel threatened, leaving pro-life advocates open to criminal charges that are difficult to disprove and chilling constitutionally protected expression,” [New Jersey Right to Life director Marie] Tasy said.

    “No one should fear intimidation or violence for seeking healthcare, and no healthcare professional should fear punishment from another state for providing care that is legal in New Jersey,” Sherrill said in the statement.

    The legislation, S2260, creates a new crime of “interference with reproductive health care services,” prohibiting conduct such as threats, intimidation, physical obstruction, or injury involving patients and providers. Violations can constitute a fourth-degree crime carrying up to 18 months in prison and a $10,000 fine, with increased penalties in cases involving bodily injury.

    Although the law does not expressly prohibit prayer or peaceful demonstrations, pro-life advocates are concerned about how terms such as “intimidate,” “coerce,” and “threat” could be interpreted and enforced. New Jersey Right to Life Executive Director Marie Tasy argues that subjective interpretations of those terms could chill constitutionally protected speech by making people hesitant to pray, hold signs, counsel women, or offer alternatives to abortion outside facilities.

    The law also extends protections to providers and recipients of what it defines as “gender-affirming care.” In addition, New Jersey agencies are restricted from cooperating with certain out-of-state investigations or legal proceedings involving reproductive services that are lawful in New Jersey, further strengthening the state’s efforts to shield abortion and transgender procedures from actions taken by other states.

    The controversy comes amid a broader international and domestic debate over speech near abortion facilities. England and Wales have enforced abortion facility buffer zones since 2024, while Ireland established 100-meter safe-access zones around certain facilities. Such restrictions have generated religious-liberty concerns when applied to prayer and other peaceful expression near abortion providers.

    Similar First Amendment questions are emerging in New York, where proposed legislation would restrict demonstrations within 25 feet of reproductive healthcare facilities and places of worship. The Foundation for Individual Rights and Expression has warned that the proposal could create numerous areas in which otherwise protected protest activity is prohibited, particularly in densely populated communities.

    New Jersey’s new law raises two profound concerns: the protection of unborn life and the preservation of Americans’ First Amendment freedoms. Violence, threats, and physical obstruction should never characterize pro-life advocacy, but peaceful prayer, compassionate counseling, and the offer of alternatives to abortion have long been important parts of the pro-life movement. Let’s pray that the constitutional rights of pro-lifers to protest and pray are protected!
