    Louisiana Wins Big Legal Fight Against FDA Over Abortion Pill Rules

    A federal appeals court just sided with Louisiana in a major case over the abortion pill, mifepristone. The ruling could make it much harder to get the pill mailed to people across the country. It’s one of the biggest wins yet for states trying to hold the FDA accountable for loosening safety rules around the drug.

    The case started in October 2025, when Louisiana sued the FDA. The state argued that the FDA broke the rules back in 2016, and again between 2021 and 2023, when it removed key safety steps for the abortion pill. Those changes let doctors skip an in-person visit before prescribing the pill, allowed the pill to be mailed straight to patients instead of picked up in person, and let people use it later into pregnancy than before. Louisiana said the FDA never properly proved these changes were safe.

    On May 1, 2026, three judges on the Fifth Circuit Court of Appeals agreed with Louisiana. They paused the FDA’s 2023 rules while the bigger legal case continues. The judges said the FDA likely broke the law when it dropped the in-person visit requirement. Here’s why: the FDA said there weren’t many safety problems reported, but that’s because the FDA had already stopped requiring people to report them in the first place. The judges also said the FDA admitted its own research didn’t actually prove that mailing the pill was safe, and the agency was still collecting more data as recently as April 2026.

    The court also looked closely at how Louisiana was being harmed. The state said the FDA’s rules were allowing close to 1,000 abortions a month that break Louisiana’s own state law, since people could just get the pill mailed to them without ever going to a clinic. Louisiana also pointed to real costs: $92,000 in Medicaid money spent in 2025 alone for emergency care for just two women who had problems after taking the pill. The judges agreed these harms were serious and hard to undo. They decided Louisiana’s right to enforce its own laws mattered more than the FDA’s unfinished review or drug companies’ profits.

    This isn’t the end of the case. It’s a pause, meaning the FDA’s looser rules are on hold while the lawsuit keeps going. But the judges’ strong wording suggests they think Louisiana has a good shot at winning the whole case. If Louisiana wins, the FDA could be forced to bring back in-person doctor visits and stop mailing the pill, at least in states with laws like Louisiana’s. That would be a big change in how the abortion pill is given out nationwide.

    This case matters because it shows something many believers have long suspected: that government agencies have cared more about making abortion easier to access than about protecting women’s health or following the law. The court itself found that the FDA used weak evidence and shaky reasoning to remove safety rules. That should concern anyone who cares about the law being followed and about women’s safety. Scripture reminds us that life is precious and that leaders are called to govern with justice and truth (Romans 13:1-4, Psalm 139:13-16). Pray for the judges still handling this case, for truth to win out over political pressure, and for women considering abortion to change their minds and choose life.
