(BREITBART) \u2013 The Department of War (DOW) is escalating its review of Sen. Mark Kelly (D-AZ), a retired Navy captain, to an official command investigation into his participation in a video dubbed \u201cseditious\u201d by President Donald Trump and War Secretary Pete Hegseth.\n<\/p>\n

DOW officials\u00a0announced\u00a0the preliminary review on November 24 in response to a\u00a0video he\u00a0published<\/a>\u00a0with fellow Democrat lawmakers calling on military service members and intelligence officials to \u201crefuse illegal orders\u201d from the Trump administration.\n<\/p>\n

Hegseth called the video \u201cdespicable, reckless, and false,\u201d calling Kelly, Sen. Elissa Slotkin (D-MI), and Reps. Chris Deluzio (D-PA), Chrissy Houlahan (D-PA), Maggie Goodlander (D-NH), and Jason Crow (D-CO) the \u201cSeditious Six\u201d in a social media post.\n<\/p>\n

While four of the other participants in the video are former military, Hegseth explained that they are not \u201cretired\u201d so they \u201care no longer subject\u201d to the Uniform Code of Military Justice (UCMJ).\n<\/p>\n

The video made by the \u201cSeditious Six\u201d was despicable, reckless, and false. Encouraging our warriors to ignore the orders of their Commanders undermines every aspect of \u201cgood order and discipline.\u201d Their foolish screed sows doubt and confusion, which only puts our warriors in danger.\n<\/p>\n

\u201cHowever, Mark Kelly (retired Navy Commander) is still subject to UCMJ \u2014 and he knows that,\u201d the secretary stated. \u201cAs was announced, the Department is reviewing his statements and actions, which were addressed directly to all troops while explicitly using his rank and service affiliation \u2014 lending the appearance of authority to his words. Kelly\u2019s conduct brings discredit upon the armed forces and will be addressed appropriately.\u201d\n<\/p>\n

The investigation could result in further actions, including recalling Kelly to active duty status to initiate \u201ccourt-martial proceedings or administrative measures,\u201d the DOW\u00a0said<\/a>.\n<\/p>\n

A DOW official confirmed that the probe has been escalated in a Monday evening statement to Breitbart News:\n<\/p>\n

The Office of the Secretary of War, in conjunction with the Department of War\u2019s Office of the General Counsel, is escalating the preliminary review of Captain Mark Kelly, USN (Ret.), to an official Command Investigation. Retired Captain Kelly is currently under investigation for serious allegations of misconduct. Further official comments will be limited to preserve the integrity of the proceedings.<\/p>\n

Command investigations are conducted in various situations, with Crisp and Associates Military Law\u00a0explaining\u00a0that they can take place when there are allegations of \u201cmisconduct, breaches of discipline, or criminal activities within the command.\u201d\n<\/p>\n

Kelly responded to the escalation in a Monday night statement\u00a0obtained<\/a>\u00a0by Fox News\u2019s Chad Pergram:\n<\/p>\n

It should send a shiver down the spine of every patriotic American that the president and secretary of defense would abuse their power to come after me or anyone this way.\n<\/p>\n

It wasn\u2019t enough for Donald Trump to say I should be hanged. It wasn\u2019t enough for Pete Hegseth to threaten me with a court martial. Now they are threatening everything I fought and served for across twenty-five years in the U.S. Navy\u2014all because I repeated something every service member is taught.\n<\/p>\n

The United States has the most professional military in the world\u2014I trust their integrity. What I don\u2019t trust is Pete Hegseth, a recklessly unqualified secretary of defense who has already shown he will corrupt any process to make an example out of me and send a message to every veteran and every American that they shouldn\u2019t speak out.\n<\/p>\n

If Trump and Hegseth think this will stop me from doing what I\u2019ve done every day of my adult life\u2014fighting for this country\u2014then they\u2019ve got the wrong guy. Tomorrow, and the next day, I will keep doing my job representing Arizona.<\/p>\n

Trump posted several messages on Truth Social about the controversial video, at one point\u00a0saying\u00a0the \u201cseditious behavior\u201d is \u201cpunishable by DEATH!\u201d He also reposted other people\u2019s comments on the topic, including one that read, \u201cHang them George Washington would.\u201d\n<\/p>\n

He later\u00a0clarified\u00a0in a radio\u00a0interview\u00a0with Fox News\u2019s Brian Kilmeade that he was not threatening to kill the Democrat lawmakers.\n<\/p>\n

\u201cI\u2019m not threatening them, but I think they\u2019re in serious trouble. I would say they\u2019re in serious trouble. I\u2019m not threatening death, but I think they\u2019re in serious trouble. In the old days, it was death,\u201d he said.\n<\/p>\n

Kelly\u2019s attorney, Paul J. Fishman of Arnold & Porter law firm, publicly shared a letter he sent to Secretary of the Navy John Phelan earlier in the day, prior to the escalation.\n<\/p>\n

\u201cTo be clear: there is no legitimate basis for any type of proceeding against Senator Kelly, and\u00a0any such effort would be unconstitutional and an extraordinary abuse of power,\u201d he said. \u201cIf the Executive Branch were to move forward in any forum\u2014criminal, disciplinary, or administrative\u2014we will take all appropriate legal action on Senator Kelly\u2019s behalf to halt the Administration\u2019s unprecedented and dangerous overreach.\u201d\n<\/p>\n
