{"id":21532,"date":"2026-03-09T19:34:41","date_gmt":"2026-03-09T19:34:41","guid":{"rendered":"https:\/\/biblelon.com\/?p=21532"},"modified":"2026-03-09T19:34:41","modified_gmt":"2026-03-09T19:34:41","slug":"lawsuit-seeks-to-pull-states-abortion-amendment-from-november-ballot","status":"publish","type":"post","link":"https:\/\/biblelon.com\/?p=21532","title":{"rendered":"Lawsuit Seeks to Pull State&#8217;s Abortion Amendment From November Ballot"},"content":{"rendered":"<p>\n              <span class=\"span-reading-time rt-reading-time\"><span class=\"rt-label rt-prefix\">Reading Time:<\/span> <span class=\"rt-time\"> 3<\/span> <span class=\"rt-label rt-postfix\">minutes<\/span><\/span><\/p>\n<p>A new lawsuit in Virginia is seeking to remove a proposed constitutional amendment that would create a right to abortion from this year\u2019s ballot.\n<\/p>\n<h4>Have you taken your place on the wall?<\/h4>\n<p>\u00a0<\/p>\n<p>The conservative law firm the Liberty Counsel filed a\u00a0complaint\u00a0last week in the Circuit Court of Bedford County, Virginia, on behalf of Bedford County Board of Supervisors member Charla Bansley.\n<\/p>\n<p>Defendants named in the lawsuit include Virginia House of Delegates Clerk G. Paul Nardo, Virginia Elections Commissioner Steven Koski, the Virginia State Board of Elections, the Virginia Department of Elections, Bedford County Registrar of Elections Barbara Gunter, and Bedford County Circuit Court Clerk Judy Reynolds.\n<\/p>\n<p>The complaint alleges that defendants failed to properly follow the procedure when passing the abortion amendment and putting it on the November ballot for voters to consider.\n<\/p>\n<p>The allege steps missed include failure to distribute the proposal to the clerks of every circuit court in the state and failure to have the proposed amendment posted three months before the next intervening House of Delegates election.\n<\/p>\n<p>The complaint accuses the defendants of violating Virginia Code and the Virginia state constitution, and asked the court to prevent the defendants from printing 2026 ballots with the amendment included.\n<\/p>\n<p>\u201cVirginia\u2019s House Joint Resolution 1 cannot legally appear on the ballot,\u201d said Liberty Counsel Founder and Chairman Mat Staver in a\u00a0statement\u00a0released Wednesday.\n<\/p>\n<p>\u201cThis measure is invalid because the General Assembly advanced it to a second legislative vote without completing the constitutionally mandated notice and posting requirements that must occur after its first passage.\u201d\n<\/p>\n<p>Staver stated that \u201cany misstep\u201d in the state constitutional amendment procedure \u201cundermines the integrity of the amendment process and can interfere with the will of the voters.\u201d\n<\/p>\n<p>In 2025, Virginia lawmakers advanced a\u00a0proposed amendment\u00a0that would create a \u201cFundamental Right to Reproductive Freedom.\u201d In January, the Democrat-controlled General Assembly approved House Joint Resolution 1, which completed the process for adding the proposal to the 2026 November ballot.\n<\/p>\n<p>Democrat Sen. Jennifer Boysko of Fairfax, who sponsored the upper chamber\u2019s version of the resolution, told the\u00a0Virginia Mercury\u00a0that the lawsuit is \u201ca frivolous attempt to silence Virginia voters.\u201d\n<\/p>\n<p>The proposed amendment declares that \u201cevery individual has the fundamental right to reproductive freedom, including the ability to make and carry out decisions relating to one\u2019s own prenatal care, childbirth, postpartum care, contraception, abortion care, miscarriage management, and fertility care.\u201d\n<\/p>\n<p>\u201cAn individual\u2019s right to reproductive freedom shall not be, directly or indirectly, denied, burdened, or infringed upon unless justified by a compelling state interest achieved by the least restrictive means,\u201d states the proposed amendment.\n<\/p>\n<p>While the proposed amendment also said that \u201cthe Commonwealth may regulate the provision of abortion care in the third trimester,\u201d it bans the regulation of abortion in cases where a physician determines it is necessary to \u201cprotect the life or physical or mental health of the pregnant individual\u201d or because \u201cthe fetus is not viable.\u201d\n<\/p>\n<p>The final votes for the proposal fell along party lines, with the House of Delegates approving it in a\u00a064-34 vote\u00a0while the state Senate approved the resolution in a\u00a021-18 vote.\n<\/p>\n<p>At present, Virginia is the only state in the South not to pass additional restrictions on abortion since the U.S. Supreme Court overturned\u00a0<em>Roe v.
