{"id":23378,"date":"2026-03-23T08:14:38","date_gmt":"2026-03-23T08:14:38","guid":{"rendered":"https:\/\/biblelon.com\/?p=23378"},"modified":"2026-03-23T08:14:38","modified_gmt":"2026-03-23T08:14:38","slug":"californias-trans-agenda-suffers-another-legal-blow","status":"publish","type":"post","link":"https:\/\/biblelon.com\/?p=23378","title":{"rendered":"California\u2019s trans agenda suffers another legal blow"},"content":{"rendered":"<p>\n              <span class=\"span-reading-time rt-reading-time\"><span class=\"rt-label rt-prefix\">Reading Time:<\/span> <span class=\"rt-time\"> 3<\/span> <span class=\"rt-label rt-postfix\">minutes<\/span><\/span><\/p>\n<p>(FOX NEWS) \u2013 Conservatives celebrated Tuesday after a federal appeals court denied California\u2019s request to narrow a\u00a0Supreme Court ruling\u00a0on transgender policies, two weeks after the high court dealt the state a major blow in the same case.\n<\/p>\n<h4><span class=\"NormalTextRun SCXW125642568 BCX0\" data-ccp-parastyle=\"x_msonormal\" data-ccp-parastyle-defn=\"&quot;ObjectId&quot;:&quot;dff0ac53-c08a-53af-8c37-6898e9240927\">Do you want\u00a0<\/span><span class=\"NormalTextRun ContextualSpellingAndGrammarErrorV2Themed SCXW125642568 BCX0\" data-ccp-parastyle=\"x_msonormal\">s<\/span><span class=\"NormalTextRun ContextualSpellingAndGrammarErrorV2Themed SCXW125642568 BCX0\" data-ccp-parastyle=\"x_msonormal\">tate<\/span><span class=\"NormalTextRun SCXW125642568 BCX0\" data-ccp-parastyle=\"x_msonormal\">\u00a0<\/span><span class=\"NormalTextRun SCXW125642568 BCX0\" data-ccp-parastyle=\"x_msonormal\">p<\/span><span class=\"NormalTextRun SCXW125642568 BCX0\" data-ccp-parastyle=\"x_msonormal\">rayer\u00a0<\/span><span class=\"NormalTextRun SCXW125642568 BCX0\" data-ccp-parastyle=\"x_msonormal\">a<\/span><span class=\"NormalTextRun SCXW125642568 BCX0\" data-ccp-parastyle=\"x_msonormal\">lerts<\/span><span class=\"NormalTextRun SCXW125642568 BCX0\" data-ccp-parastyle=\"x_msonormal\">?\u00a0<\/span><\/h4>\n<p>\u00a0<\/p>\n<p class=\"speakable\">\u201cCalifornia has now lost at the district court, lost at the Supreme Court, and been turned away by the Ninth Circuit,\u201d Executive Vice President of the Thomas More Society Peter Breen said in a statement. \u201cThe state has repeatedly tried to paint parents who don\u2019t immediately accept their children\u2019s assertion of a new name and gender as \u2018abusive.\u2019 The courts have resoundingly rejected that premise.\u201d\n<\/p>\n<p>The Supreme Court had temporarily blocked California officials on March 2 from interfering with school policies that require parents to be notified if their child identifies as transgender.\n<\/p>\n<p>Democrat California Attorney General Rob Bonta\u2019s office responded by turning to the U.S. Court of Appeals for the 9th Circuit to seek clarification on the high court\u2019s ruling in an effort to interpret it more narrowly.\n<\/p>\n<p>A three-judge panel comprising three Democrat-appointed judges acknowledged that Bonta\u2019s office raised \u201cimportant concerns\u201d about whether the injunction upheld by the Supreme Court would force schools to disclose gender-related details to parents \u201cwho would engage in abuse.\u201d But, the panel said, that was for the lower court to decide at this stage.\n<\/p>\n<p>The Thomas More Society, a Catholic-based law firm helping to represent the parents and teachers who brought the lawsuit against the state, added that the 9th Circuit effectively told California officials on Tuesday they cannot use the appellate court as a \u201cbackdoor to rewrite\u201d the Supreme Court\u2019s ruling.\n<\/p>\n<p>Civil rights lawyer\u00a0Laura Powell\u00a0noted that Bonta\u2019s \u201cattempt to circumvent SCOTUS\u2019s order\u201d had failed and that the district court judge, an appointee of former President George W. Bush, would likely side against Bonta again.\n<\/p>\n<p>\u201cGood like convincing Judge [Roger] Benitez to back down after being vindicated by SCOTUS!\u201d Powell wrote.\n<\/p>\n<p>Benitez had issued the initial preliminary injunction that the Supreme Court upheld, and the same judge will continue to preside over the broader case as it plays out in court.\n<\/p>\n<p>The\u00a0lawsuit, Mirabelli v. Bonta, was brought by California parents and teachers who argued that the state\u2019s policy violated their rights under the First and Fourteenth Amendments. The parents said the policy prevented school administrators from telling them about their child\u2019s potential efforts to engage in gender transitioning unless the child consented to it.
