But the state’s high court ruled it was too late, emphasizing early voting was open by that point, with 40 percent of ballots already cast.

“While the Commonwealth is free by its lights to do the right thing for the right reason, the Rule of Law requires that it be done the right way,” Kelsey wrote.

The ruling represents a significant setback for Democrats hoping to gain additional congressional seats in Virginia ahead of the midterm elections. The proposed map would have dramatically shifted the political balance of the state’s congressional delegation, giving Democrats four additional pickup opportunities in their effort to retake control of the U.S. House.

At the center of the case was a constitutional dispute over procedure. Virginia’s Constitution requires that proposed constitutional amendments pass through two separate legislative sessions with an election occurring in between. Democrats argued they complied with the law because Election Day had not yet officially occurred when lawmakers cast the first vote. However, the court concluded that early voting had already begun, meaning the election process was already underway and the constitutional requirement had not been properly satisfied.

The ruling also highlights the growing national battle over redistricting as both parties aggressively pursue favorable congressional maps ahead of the next election cycle. States across the country — including Texas, Florida, Louisiana, and Tennessee — have become battlegrounds in an escalating fight over congressional district lines and political control of the House of Representatives.

President Donald Trump celebrated the decision on Truth Social, calling it a “huge win for the Republican Party, and America, in Virginia.” Meanwhile, Virginia Democrats vowed to continue fighting for changes they say better reflect the will of voters.

IFA covered Virginia’s gerrymandering efforts, and this verdict is an answer to our prayers!
