Brendan Carr Sets the Record Straight"},"content":{"rendered":"<p>\n              <span class=\"span-reading-time rt-reading-time\"><span class=\"rt-label rt-prefix\">Reading Time:<\/span> <span class=\"rt-time\"> 4<\/span> <span class=\"rt-label rt-postfix\">minutes<\/span><\/span><\/p>\n<p>Federal Communications Commission Chairman Brendan Carr is pushing back after a TV broadcaster owned by the\u00a0Walt Disney Company\u00a0accused the commission of violating the First Amendment.\n<\/p>\n<h4>Get involved in state-level prayer with IFA.<\/h4>\n<p>\u00a0<\/p>\n<p>WABC-TV, a New York affiliate of the American Broadcasting Corporation, objected to the FCC ordering the station to apply for early license renewal amid an investigation into so-called diversity, equity, and inclusion\u00a0practices at Disney.\n<\/p>\n<p>\u201cThe order has\u00a0<em>no<\/em>\u00a0legitimate purpose,\u201d the station wrote.\u00a0The TV station\u00a0claimed that the order is \u201cplainly incompatible with the First Amendment, categorizing it as an \u201ceffort to suppress speech under the guise of bureaucratic process.\u201d\n<\/p>\n<p>Carr, however, emphasized President Donald Trump\u2019s executive orders, which directed federal agencies to apply laws forbidding racial discrimination, regardless of claims that DEI practices are necessary to reverse historic discrimination.\n<\/p>\n<p>\u201cIf a broadcaster engaged in illegal DEI discrimination, the FCC will hold them accountable,\u201d he told\u00a0the Daily Signal\u00a0in a statement Friday.\n<\/p>\n<p>\u201cThe FCC has been investigating Disney based on DEI concerns for over a year now,\u201d Carr added. The FCC opened the investigation in March 2025.\n<\/p>\n<p>\u201cThe agency determined that Disney\u2019s responses to date have been deficient, disingenuous, and incomplete.\u00a0The FCC will follow the facts and law wherever they lead,\u201d Carr said.\n<\/p>\n<h2 class=\"wp-block-heading\">The DEI Disney Investigation<\/h2>\n<p>Carr announced the investigation in a\u00a0letter to Disney CEO Bob Iger\u00a0last year.\n<\/p>\n<p>\u201cAs you may know, the Communications Act and Commission rules prohibit regulated entities like Disney\u2019s ABC from discriminating on the basis of race, color, religion, national origin, age, or gender,\u201d the FCC chairman wrote. \u201cIndeed, the FCC\u2019s longstanding equal employment opportunity or [equal employment opportunity] rules set forth specific requirements to which Disney\u2019s regulated operations must adhere.\u201d\n<\/p>\n<p>Carr cited a list of \u201cpublic reports\u201d painting \u201ca disturbing picture of Disney\u2019s DEI practices,\u201d including efforts to launch racially-segregated affinity groups and spaces, mandatory standards forcing racial and identity quotas into multiple levels of production, use of race-based hiring databases, and restricting fellowships to select demographic groups. The spectrum is a finite resource, so the FCC regulates it to prevent interference, promote fair access, and maximize public benefit.\n<\/p>\n<p>The FCC\u00a0issued a public notice\u00a0Thursday, emphasizing that broadcasters such as ABC do not have a right to spectrum and that broadcasters using spectrum have an obligation to do so in the public interest.\n<\/p>\n<p>\u201cNo broadcaster has a \u2018right\u2019 to use the public spectrum,\u201d the notice explains. \u201cIndeed, the U.S. Supreme Court has recognized that certain FCC regulatory efforts in furtherance of its statutory mandate \u2018enhance rather than abridge the freedoms of speech and press protected by the First Amendment.\u2019\u201d The notice cites Red Lion v. FCC (1969).\n<\/p>\n<p>The notice explains that federal law prohibits broadcasters from engaging in \u201cnews distortion,\u201d requires them to \u201cprovide equal opportunity to political candidates,\u201d and forbids them from airing \u201cobscene, indecent, and profane content, or broadcast hoaxes.\u201d\n<\/p>\n<p>\u201cProgramming decisions by broadcasters must be made in service of the public,\u201d the notice adds. The FCC promotes its \u201ctraditional public interest goals of promoting competition, localism, and viewpoint diversity.\u201d\n<\/p>\n<p>When the FCC finds that a broadcaster has failed to serve the public interest, it may take action, including requiring a licensee to file an early renewal application, terminating renewals, or granting renewal applications with conditions or on a short-term basis.\n<\/p>\n<p>The FCC launched a separate inquiry into whether \u201cThe View\u201d qualifies for an exemption from equal-time rules, which require shows that invite candidates on during elections to also extend invitations to those candidates\u2019 opponents. The agency is seeking public comments about whether \u201cThe View\u201d should be considered a bona fide news program.\n<\/p>\n<p>When it comes to the spectrum license renewal, WABC-TV\u2019s objection noted that the FCC \u201chad not demanded early renewal in over five decades.\u201d\n<\/p>\n<p>Disney\u2019s DEI practices began comparatively recently, however, and the Trump administration\u2019s efforts to enforce federal bans on racial discrimination in response to these policies only started in 2025.\n<\/p>\n<p dir=\"ltr\" lang=\"en\">\ud83d\udea8YOU CAN FIGHT BACK\n<\/p>\n<p>Are you sick of TV and streaming shows pushing transgender ideology on your kids?
