\u201cICE has determined that the information you requested is being withheld in full pursuant to Title 5 U.S.C. \u00a7 552(b)(7)(A). Disclosure of any responsive records at this time could reasonably be expected to interfere with enforcement proceedings,\u201d ICE told Just the News<\/em> in response to the FOIA in May.\n<\/p>\n The FOIA exemption cited by the agency \u201capplies to records or information compiled for law enforcement purposes when their release could disrupt such proceedings,\u201d the reply reads.\n<\/p>\n \u2026\n<\/p>\n The Department of Justice guidelines for invoking exemption 7(A) say that doing so requires a two-step assessment. \u201cFirst, there must be a \u2018reasonable likelihood\u2019 of a pending or contemplated law enforcement proceeding,\u201d the guidance says. \u201cSecond, release of the information must be reasonably expected to cause some articulable harm to that proceeding.\u201d<\/p>\n The records request stems from longstanding allegations concerning Omar\u2019s marriage to Ahmed Nur Said Elmi from 2009 to 2017. Critics have alleged that Elmi was Omar\u2019s brother and that the marriage was intended to help him remain in the United States. Omar has consistently denied the allegation, and no court record, DNA evidence, or other documentary proof has established that Elmi was her biological brother.\n<\/p>\n The controversy dates back to Omar\u2019s 2016 campaign for the Minnesota House of Representatives, but it received renewed attention after Trump administration officials indicated that federal authorities were examining the allegations. Border czar Tom Homan said in December 2025 that the Department of Homeland Security was pulling records and files related to the matter.\n<\/p>\n Vice President JD Vance subsequently confirmed in May that the Justice Department was reviewing the allegations while cautioning against prejudging the outcome. \u201cIf we think that there\u2019s a crime, we\u2019re going to prosecute that crime,\u201d Vance said, adding that the DOJ was examining the matter.\n<\/p>\n ICE\u2019s FOIA response provides additional evidence that some form of law-enforcement proceeding is pending or contemplated, though it does not establish Omar\u2019s guilt or disclose precisely what authorities are investigating. DOJ guidance says the exemption invoked by ICE may be used when releasing law-enforcement records could cause harm to a proceeding, such as tipping off potential suspects or exposing an investigation to witness tampering.\n<\/p>\n The case comes as the Trump administration has made immigration enforcement and alleged immigration fraud significant priorities. Whatever federal investigators ultimately determine, public officials should be held to the same laws and standards as every other American.
