The case, filed against the School District of the Chathams, is drawing national attention as parents, legal advocates, and Christian organizations argue the policy openly defies recent Supreme Court rulings affirming parental rights in education.\n<\/p>\n<h4>Post a prayer for your state!<\/h4>\n<p>\u00a0<\/p>\n<p>From Fox News:\n<\/p>\n<p>Under the School District of the Chathams\u2019 policy, students are able to change their name in official school records, use the bathrooms and locker rooms that align with their gender identity, and the school guidance counselor decides \u201cwhether, and to what extent\u201d parents are involved in the decision.\n<\/p>\n<p>\u201cThe policy provides that this information will be hidden from them, so they have the right to object to it, whether or not their particular child or children is at that moment being transitioned. And there\u2019s always a risk, of course, that the child under peer pressure, or the influence of teachers, or social media, will go along with this ridiculous trend and decide that his gender is not the biological one that parents believe is God-given and immutable, but some other gender.\u201d\n<\/p>\n<p>\u201cThey have a policy in the school district that will actually punish children that don\u2019t use the demanded new gender identity pronoun and name of another student,\u201d Descovich told Fox News Digital. \u201cThey can do that just one time on accident, and they can be punished up to suspension just for using the wrong pronoun or the wrong name of someone that is identifying as something other than they actually are.\u201d<\/p>\n<p>The lawsuit was filed Aug. 24 by the Thomas More Society\u2019s senior counsel Christopher Ferrara, on behalf of Moms for Liberty and two anonymous parents of elementary school-aged daughters. The plaintiffs allege the district is violating their First Amendment rights to free speech and religious liberty, as well as the Due Process Clause of the 14th Amendment. They also argue the school is violating parental rights affirmed by the Supreme Court in\u00a0<em>Mahmoud v. Taylor<\/em>, which determined that parents can opt their children out of LGBT-centered lessons.\n<\/p>\n<p>Ferrara argued that the school\u2019s policy flies in the face of the Supreme Court\u2019s ruling in\u00a0<em>Mirabelli v. Bonta<\/em>, decided in March, which granted an injunction against California over similar policies that keep students\u2019 gender identities confidential from parents. He noted the Third Circuit has issued a ruling along the same lines, establishing that parents have legal standing to challenge policies that hide a child\u2019s gender transition from them \u2014 regardless of whether their own child is currently seeking to transition.\n<\/p>\n<p>In a June 15 school board meeting, Ann Ciccarelli, president of the Chatham School District Board of Education, said the district was not legally bound by the\u00a0<em>Mirabelli<\/em>\u00a0decision and was instead required to follow the New Jersey Department of Education\u2019s 2018 guidance on transgender students. However, New Jersey Attorney General Matthew Platkin has acknowledged that Policy 5756 is not mandatory. Moms for Liberty CEO and founder Tina Descovich said the Supreme Court has now ruled twice on these issues, making the district\u2019s continued defiance difficult to justify legally or morally.\n<\/p>\n<p>Ferrara also told Fox News Digital that parents who have spoken out against the policy have faced threats and intimidation, with at least one family requiring police security outside their home. He described the backlash as characteristic of what happens when anyone challenges these policies publicly, calling it a \u201cvicious\u201d response from ideologues intolerant of what he described as the mainstream position on child-rearing and parental authority.\n<\/p>\n<p>For Christians, this case strikes at something foundational: the God-given role of parents to raise and guide their children. Proverbs 22:6 calls parents to train up a child in the way they should go, and Ephesians 6:4 charges fathers specifically with bringing children up in the instruction of the Lord. When a public school system appoints itself as the gatekeeper of a child\u2019s most intimate identity decisions \u2014 and actively hides those decisions from the child\u2019s own parents \u2014 it usurps an authority that belongs to the family, not the state. As courts continue to weigh these questions, Christians are called to pray fervently for the protection of parental rights, for the children caught in the middle, and for school officials to have the courage to act in accordance with truth rather than ideology.\n<\/p>\n<p>Let us pray for the families involved in this lawsuit, for Christopher Ferrara and the Thomas More Society as they argue this case in court, and for Tina Descovich and Moms for Liberty as they fight for parental rights across the nation. May God protect the children of the Chathams school district and all those affected by similar policies, and may our courts uphold the rights of parents to be involved in their children\u2019s lives.
