Hancock said that the program was constitutionally questionable because of its emphasis on race.\n<\/p>\n<p>\u201cIn Texas, we don\u2019t want to discriminate against anybody, and what this program does is literally discriminate against those that are white,\u201d Hancock told The Daily Wire. \u201cIt\u2019s just been around for a long time, and we\u2019ve just kind of accepted it and not looked at the constitutionality of it.\u201d\n<\/p>\n<p>To be defined as a Historically Underutilized Business, the company must be more than 50% owned by black Americans, Hispanic Americans, Asian Pacific Americans, Native Americans, service-disabled veterans, or women. The program has been in place since 1991. Hancock explained the requirements as \u201cunless you\u2019re white, you qualify.\u201d<\/p>\n<p>According to the Daily Wire, Historically Underutilized Business are entitled to preferential treatment, including \u201copportunities to bid for contracts from around 300 state agencies that must make a \u2018good faith\u2019 effort to reach out to them.\u201d\n<\/p>\n<p>Hancock raised concerns about the program, stating that determining whether someone was economically discriminated against has to be based on more than just skin color. He added that contracts should be awarded based on merit, not race.\n<\/p>\n<p>It\u2019s encouraging that Texas is making efforts to root out all institutionalized discrimination.
