    Louisiana Pushes Court to Fast-Track Challenge to Mail-Order Abortion Pills

    A legal battle over the abortion pill mifepristone is intensifying as Louisiana pushes for a faster court ruling on federal policies that allow the drug to be prescribed through telehealth and delivered by mail. Pro-life advocates argue that the current rules endanger women, undermine state pro-life laws, and make it easier for abortion drugs to be administered without a woman’s knowledge or consent.

    The case comes as federal officials continue reviewing the safety of mifepristone and as reports of alleged coercive use of the drug draw increasing attention nationwide.

    When the Supreme Court stopped an appeals court from blocking a federal rule allowing mail-order prescriptions of mifepristone while a legal challenge continues against the abortion pill’s prescribing conditions, the high court extended the opportunity for abusive partners and parents to acquire the pill and secretly or coercively give it to women with wanted pregnancies.

    As criminal charges for nonconsensual administration of the pill grow, documented by Susan B. Anthony Pro-Life America’s tracking of cases nationwide, Louisiana is pressing the 5th U.S. Circuit Court of Appeals to rush legal proceedings and issue a final ruling on the Food and Drug Administration’s regulatory changes, made after it curtailed safety data collection.

    Both district and appellate judges agreed Louisiana faces “irreparable harm” every day the FDA’s 2023 Risk Evaluation and Mitigation Strategy for mifepristone remains, undermining its pro-life laws and forcing it to “spend Medicaid funds on emergency care for women harmed by mifepristone,” the motion for expedited oral argument Monday says.

    At the center of the dispute is the FDA’s decision to make permanent a pandemic-era policy allowing mifepristone to be prescribed through telehealth appointments and shipped directly to patients. Supporters of the policy say it increases access to care, while opponents argue it removes important safeguards designed to protect women and unborn children.

    Louisiana officials contend that the FDA’s actions were not supported by adequate safety data and that the agency weakened reporting requirements for adverse events associated with the drug. Court filings argue that the federal government relied on incomplete information when expanding access to chemical abortions and failed to fully consider the consequences for states with pro-life laws.

    Pro-life organizations have also pointed to a growing number of criminal cases involving allegations that abortion drugs were secretly administered to pregnant women. One recent Louisiana case involved a woman who reportedly received the drug without her knowledge while more than halfway through her pregnancy, leading to an emergency medical situation and the premature birth of her child. Advocates say such incidents underscore the risks associated with mail-order abortion drugs and the absence of in-person medical oversight.

    Meanwhile, the Trump administration’s Department of Health and Human Services continues its review of mifepristone’s safety. FDA Commissioner Kyle Diamantas has reportedly made the review a top priority, while HHS Secretary Robert F. Kennedy Jr. previously pledged a comprehensive examination of the drug’s risks and regulatory history.

    The outcome of the Louisiana case could have far-reaching implications for abortion policy nationwide. A ruling against the FDA’s current approach could restore stricter dispensing requirements and reshape how abortion drugs are distributed across the country, particularly in states that have enacted protections for unborn children after the Dobbs decision.
