    DOJ Sues Virginia, Warns Against Sanctuary Policies

    A new legal battle is unfolding between the Trump administration and Virginia over immigration enforcement, with the Department of Justice arguing that recently enacted state laws improperly interfere with federal authority.

    The lawsuit marks the latest chapter in a broader national dispute over the relationship between state governments and federal immigration agencies, particularly as the administration continues its efforts to increase enforcement and cooperation with local law enforcement.

    “We are suing Virginia to prevent Virginia from becoming the next sanctuary jurisdiction, just like California,” DOJ Assistant Attorney General for the Civil Division Brett Shumate told Fox News Digital in a Zoom interview.

    The lawsuit, first shared with Fox News Digital earlier in June, argues Virginia is violating the Constitution by trying to regulate federal law enforcement operations, including restrictions on agents’ masks, identification requirements and conditions on local cooperation with ICE.

    “Under our Constitution, the states do not get to regulate or dictate how the federal government performs its duties, and that is especially the case when it comes to law enforcement. Virginia passed two bills in this newest session, one that restricts the ability of law enforcement officers to wear facial coverings and requires officers, federal agents, to wear identification badges,” said Shumate.

    According to the Department of Justice, the challenged laws would impose new restrictions on federal immigration agents and limit the ability of local law enforcement agencies to voluntarily cooperate with Immigration and Customs Enforcement. Federal officials argue that such requirements violate the Constitution’s Supremacy Clause, which generally prevents states from interfering with federal operations.

    The lawsuit names Virginia Attorney General Jay Jones and Fairfax County Commonwealth’s Attorney Steve Descano. DOJ officials have pointed to a similar legal challenge in California, where a federal appeals court blocked enforcement of a state law requiring federal immigration agents to display identification during enforcement activities.

    Virginia’s legislation is scheduled to take effect on July 1, prompting the Justice Department to seek an injunction before the laws become active. Administration officials contend that the measures could expose federal agents to harassment, doxing, and potential safety risks during immigration enforcement operations.

    Supporters of the Virginia laws have argued that identification requirements promote transparency and accountability for law enforcement officers operating within communities. Critics, however, maintain that such restrictions could hinder federal enforcement efforts and place agents in danger amid heightened tensions surrounding immigration policy.

    The outcome of the case could have implications beyond Virginia. DOJ officials have warned that other states considering similar legislation may face comparable legal challenges, signaling the administration’s intent to aggressively defend federal authority over immigration enforcement.
