The Supreme Court handed the Trump administration another significant immigration victory Thursday, reaffirming the executive branch’s authority to end Temporary Protected Status for certain groups of migrants. The Supreme Court issued a key decision on the issue of immigration on Thursday, ruling that the Trump administration has the authority to end Temporary Protected Status (TPS) for certain refugees living in the U.S.
The immigrants affected by this case were granted Temporary Protected Status under a law passed by Congress in 1990. The program allows the Homeland Security Secretary to let people from certain countries remain and work in the U.S. when conditions back home make it unsafe to return. That same law also gives the secretary the authority to end those protections.
“It gives people protection while the country’s in turmoil or after they suffer a hurricane,” explained Border Czar Tom Homan during a press briefing Thursday.
Temporary Protected Status (TPS) was established by Congress through the Immigration Act of 1990 to provide temporary humanitarian relief to foreign nationals already present in the United States when extraordinary conditions—such as armed conflict, natural disasters, or other emergencies—make it unsafe for them to return to their home countries. The designation does not provide a pathway to permanent residency or citizenship, and Congress specifically granted the secretary of homeland security the authority to both designate and terminate TPS status as conditions change.
The Trump administration announced plans to end TPS protections for Haitians and Syrians after determining that the circumstances justifying those designations had changed. Those decisions were challenged in federal court, where lower courts temporarily blocked the administration from implementing the policy. In a 6-3 decision, however, the Supreme Court ruled that the law grants broad discretion to the Homeland Security secretary to determine when TPS protections should end, allowing the administration to move forward.
The Court also issued a separate immigration ruling Thursday permitting the Trump administration to continue turning away certain asylum seekers at the southern border while legal challenges continue. Together, the decisions represent another affirmation of the executive branch’s authority to enforce immigration law and implement policies authorized by Congress. While immigration debates often focus on compassion for migrants, these rulings also underscore the importance of faithfully applying the laws enacted by the people’s elected representatives and maintaining secure national borders.
