Acting Attorney General Todd Blanche issued an order on Aug. 2 formally rescinding President Donald Trump’s $1.8 billion “anti-weaponization” fund ahead of his nomination hearing.
“My team and I have met with committee members and Senators over the past several weeks and addressed any concerns or outstanding questions,” Blanche said in a post on X.
“We have enjoyed good faith discussions, and as a result issue the following order and update with regard to the May IRS settlement,” he said of the fund created by the Department of Justice (DOJ) to compensate victims of “weaponization and lawfare” that a court deemed to be improper.
The Senate Judiciary Committee is scheduled to meet today to consider Blanche’s nomination after postponing an earlier vote when concerns emerged over the DOJ’s creation of the fund. Sens. John Cornyn and Thom Tillis had signaled they might withhold their support unless questions surrounding the fund were resolved, making the issue a key hurdle for Blanche’s confirmation.
The anti-weaponization fund originated as part of a settlement in President Trump’s lawsuit against the Internal Revenue Service over the unauthorized disclosure of his tax returns. The proposal was intended to compensate Americans who believed they had been unfairly targeted through politically motivated investigations or prosecutions during the previous administration. According to Blanche’s order, however, the fund never became operational. No board members were appointed, no claims process was established, and no money was distributed before it was formally rescinded.
The DOJ also announced that Blanche’s order narrows the scope of a separate directive concerning tax liability protections for President Trump, his family, and affiliated entities by clarifying that those protections apply only retroactively. Department officials said the formal rescission removes any remaining uncertainty after courts continued to entertain lawsuits challenging a fund that the administration had already said would not move forward.
As the Senate prepares to vote on Blanche’s nomination, his decision underscores the importance of maintaining confidence in the Justice Department and ensuring that its actions remain consistent with the rule of law.
