    Federal Appeals Court Upholds Florida Law Protecting Children from Sexualized Performances

    Florida scored a major legal victory this week after a federal appeals court upheld a state law restricting minors from attending sexually explicit live performances, including certain drag shows. The ruling affirms the state’s authority to shield children from obscene material and could influence similar legal battles across the country.

    In an 8-5 decision, the full 11th U.S. Circuit Court of Appeals upheld Florida’s 2023 Protection of Children Act, reversing both a lower court injunction and an earlier ruling by a three-judge panel that had blocked the law from taking effect. The case stemmed from a challenge brought by Orlando’s Hamburger Mary’s Restaurant and Bar, which argued that the law violated First Amendment protections.

    Writing for the majority, Judge Andrew Brasher concluded that the state has a legitimate constitutional interest in protecting children from obscene performances. He emphasized that obscenity is not protected by the First Amendment and that Florida’s law is narrowly focused on performances involving nudity, sexual conduct, lewd behavior, or the display of prosthetic or imitation sexual body parts.

    Under the law, businesses or organizers who knowingly admit minors to prohibited performances can be charged with a misdemeanor, punishable by up to one year in jail and a fine of up to $10,000. Florida Attorney General James Uthmeier praised the decision as the culmination of a years-long legal battle to defend the state’s child protection measures.

    Not all members of the court agreed. In a dissent joined by four other judges, Judge Robin Rosenbaum argued that the law was intended to discourage drag performances specifically and warned that it could have a chilling effect on constitutionally protected expression. Nevertheless, the majority concluded that the statute regulates obscenity rather than protected speech.

    The decision places Florida alongside Arkansas, North Dakota, Tennessee, and Texas, all of which have enacted laws limiting minors’ access to sexually explicit live performances. As legal challenges continue across the country, the ruling is expected to strengthen the position of states seeking to draw clearer boundaries between adult entertainment and content deemed appropriate for children.

    Supporters of the decision argue that it reaffirms the longstanding principle that states have a responsibility to protect children from sexually explicit material. They also contend that the ruling demonstrates courts remain willing to recognize distinctions between protected artistic expression and performances that cross into legally obscene territory.

    As debates over parental rights, children’s welfare, and free speech continue, this decision is likely to become an important precedent in future cases involving the balance between constitutional protections and the government’s interest in safeguarding minors.

    The battle to protect children isn’t over — it’s just getting started. Florida’s victory shows that standing firm on biblical truth and common sense can still win in court, but laws are only as strong as the people willing to defend them. Christians must stay engaged, speak up at school boards, support legislators who protect kids, and pray for judges who uphold what’s right. Most importantly, we need to pray for the children caught in the confusion of this cultural moment — that God would guard their hearts, protect their innocence, and surround them with adults who love them enough to tell them the truth.
