Lawmakers are increasingly scrutinizing automated license plate readers such as Flock Safety cameras amid concerns about warrantless surveillance, false identifications, and misuse by law enforcement. Several members of Congress have introduced or proposed legislation restricting the technology, but as of Wednesday, no bill had been introduced that would completely ban Flock cameras nationwide.

Republican Tennessee Rep. Tim Burchett introduced the “Protection Against Mass Surveillance Act” in July to ban federal agencies from purchasing or operating Flock cameras or any form of automated surveillance that “identify, track, or record individuals.”
Republican Reps. Thomas Massie of Kentucky and Lauren Boebert of Colorado introduced the Surveillance Accountability Act in April that would require federal and local agencies to obtain a warrant before conducting surveillance on American citizens. The bill would prohibit warrantless facial recognition scanning by federal and local law enforcement agencies in public areas and restrict the use of ALPRs, including Flock cameras.

“The repeated misidentification of innocent Americans and warrantless surveillance of millions are my two largest concerns with Flock cameras,” [Republican Indiana Rep. Marlin] Stutzman told the DCNF. “No matter who you are or what you do, areas with Flock cameras are tracking you. While many localities are taking the right step in reevaluating their use of these cameras, more serious steps must be taken on the federal level to restrict any unregulated AI surveillance from taking place.”
Flock Safety operates a nationwide network of automated license plate readers that capture vehicle information and allow participating law-enforcement agencies to search collected data. The technology has proven useful in criminal investigations, but its expanding footprint has also generated debate about how easily a system designed for public safety could become a powerful surveillance network.
Several Republicans are now pursuing different approaches to limiting the technology. Rep. Anna Paulina Luna of Florida announced in July that she was working on legislation to ban Flock cameras, although that bill had not yet been introduced as of the source article’s publication. Massie has separately said he plans to propose withholding federal funding for cameras used to track Americans, while Reps. Keith Self, Eli Crane, and Andrew Clyde have introduced legislation requiring warrants before law enforcement can access certain state and local surveillance databases.
Flock maintains that an outright ban is unnecessary and argues that privacy and public safety can coexist with appropriate safeguards. The company points to court decisions finding that license plate readers operating in public spaces generally do not require warrants and has called on Congress to establish clear rules governing accountability and responsible use.
Critics, however, point to incidents demonstrating the consequences when these systems fail or are abused. Mike Fox of the Cato Institute warned about false-positive identifications, and an innocent Wisconsin driver was reportedly held at gunpoint earlier this month following a camera error. The Institute for Justice has also documented cases in which law-enforcement personnel allegedly misused license plate databases to track romantic interests. Some municipalities have responded to privacy concerns by ending their Flock contracts.
The debate is unfolding against a broader history of controversy surrounding federal surveillance powers. Past abuses involving the Foreign Intelligence Surveillance Act have intensified concerns about granting government agencies access to increasingly sophisticated tracking technology. Those concerns cross party lines: lawmakers from both parties have questioned various surveillance practices, although they have differed over how extensively those powers should be restricted.
President Donald Trump weighed in on the controversy this week, acknowledging that Flock cameras have both “pros and cons.” Congress now faces the challenge of determining whether existing constitutional protections are sufficient for rapidly advancing surveillance technology or whether stronger statutory limits are needed.
The debate highlights the tension between government’s responsibility to protect citizens and its obligation to respect their constitutional liberties. Technology capable of helping law enforcement solve crimes can also carry serious consequences when used without sufficient accountability.
