Nearly a year after Charlie Kirk was fatally shot at a Turning Point USA event, the case against his accused killer reaches a pivotal moment this week. Tyler Robinson returns to a Utah courtroom Tuesday for a hearing that could send his case to trial and, for the first time, require him to enter a plea. The outcome will determine whether the aggravated murder charge against him, which carries the potential death penalty, moves forward as prosecutors have argued it should.

Robinson, a 23-year-old from Washington, Utah, is accused of firing a single shot that killed the 31-year-old father of two during a Turning Point USA event at Utah Valley University in Orem, Utah, on Sept. 10, 2025.
While the defense has argued that prosecutors have not established enough probable cause to pursue aggravated murder, which carries the potential death penalty, experts tell Fox News Digital that they don’t expect Judge Tony Graf Jr. to take it off the table just yet.
“We’re at a preliminary hearing stage, so we’re at a very low burden,” said Skye Lazaro, a Salt Lake City-based defense attorney who is not connected to the case. “It’s probable cause, and everything is taken in a light most favorable to the state.”
The court held a week-long preliminary hearing in early July before both sides submitted briefs ahead of Tuesday’s expected ruling. Legal experts anticipate the entire case will be bound over for trial, including the sole aggravating factor that makes the charge eligible for the death penalty, an allegation that Robinson put others at great risk by firing into a crowded event. Greg Rogers, a former FBI agent and sniper who now teaches at Utah Valley University, said even a skilled shooter would consider such a shot dangerous given the unpredictability of a crowd, and that the risk is “clearly, clearly very dangerous” when the shooter is inexperienced.
Prosecutors have laid out an extensive case against Robinson, including a suspected murder weapon linked to his DNA, surveillance video, ballistic evidence, and witness statements. They allege Robinson confessed to multiple people, including his roommate, and that he wrote in a message, “I had the opportunity to take out Charlie Kirk, and I took it.” The defense has countered that only one shot was fired from an elevated position and that it struck only Kirk, arguing this weakens the claim that the crowd was endangered. It is important to note these remain allegations at this stage of the proceedings, and Robinson has not yet entered a plea.
If Judge Graf rules there is sufficient probable cause, an arraignment could follow immediately, marking the first time Robinson is asked to respond to the charges. Attorneys not connected to the case expect a not guilty plea, since prosecutors have shown no indication of offering an agreement that would remove the death penalty from consideration. Kirk’s widow, Erika, along with his parents, are expected to attend Tuesday’s hearing, as they did in July.
